What is a work permit?

 

  1. A work permit is a legal document that allows a foreign national to work in Canada for a specific period. Work permits are issued by Immigration Refugees and Citizenship Canada (IRCC) and are required for most foreign workers who wish to work in Canada.
  2. A work permit is tied to a specific job offer from a Canadian employer and is usually issued for a limited period of time either one or two years. It would indicate a specific job that the foreign worker is authorized to perform as well as any conditions or restrictions.
  3. In order to obtain a work permit, a foreign worker needs to have a job offer from a Canadian employer and demonstrate that they meet the eligibility requirement for the work permit category.

 

It is important to note that obtaining a work permit does not grant permanent residency, a foreign worker who wishes to obtain a permanent residency in Canada may need to apply for a separate immigration program.

Foreign nationals with any Nationality who wish to work temporarily in Canada may apply for a work permit if they meet certain eligibility requirements.

    1. Job offer:

    The applicant must have a job offer from a Canadian employer before they can apply for a work permit. The job offer must be genuine and non-seasonal  and must meet the requirements set out by Immigration Refugees and Citizenship Canada.

          2. Labor Market Impact Assessment Program:

    In most cases the Canadian employer must obtain a positive LMIA from Employment and Social Development Canada (ESDC) before the work permit can be issued. This assessment is to ensure that the job offer does not negatively impact on available employees  residing in Canada.

     

           3.   Health and Security;

    The applicant must undergo a medical examination and obtain a Police Clearance Certificate to ascertain that they do not pose a risk to the Canadian Society.

     It is important to note that some individuals maybe exempted from the LMIA requirement such as if they are coming under a trade agreement or if they are a spouse to a citizen or permanent resident. Individuals  who wish to apply for a work permit must meet specific eligibility requirements.

Process of obtaining a Canadian work permit .

  1. Determine eligibility:

The first step is to determine if you are eligible for a work permit and this may depend on such factors such as country of Citizenship, the type of work you will be doing and your intended length of stay.

2. Obtain a job offer:

To apply for a work permit you must have a job offer from a Canadian employer and the job offer should include details such as job description, salary and duration of employment.

3.Gather required documents:

As mentioned earlier, you will need to gather all required documents such as a valid passport, job offer and LMIA. You may also need to provide supporting documents such as proof of qualifications and language proficiency. 

4.Submit your application:
